Question:

Hello Doctor,

I'm the owner of a Pizza store for the past 5 years. I have a good store manager managing my store from the past one year.

I have discovered that he is infected with HIV as I grew suspicious about his medications, eventually found out about the medicines he takes through the internet. He is taking "Videx" and "Epivir".

My questions are:
1) Is it safe for him to work in a food industry?
2) Will he be risking the health of other workers in the store?
3) Are there any legal implications if I ask him to quit?

I would highly appreciate if you could give the right advice.

Dear Max:

I am very thankful that you chose to send me your question rather than acting abruptly. There are some very important facts for you to be aware of:

  1. It is perfectly safe for your HIV(+) employee to work in the food preparation industry.
  2. There is absolutely no risk to your employees or to your customers unless they are having unprotected sex with this individual.
  3. The legal implications to you if you ask your HIV(+) employee to quit are that you can get sued for discrimination against someone with a medical disability. I’m sure you do not want this to occur.

My advice to you is to RELAX and treat your HIV(+) employee(s) NO DIFFERENT THAN ANYONE ELSE. Everyone will be healthier and happier if this occurs.
